Procedures Applicable to Chapter 7 and 13 Cases

Scheduling of Hearings. Except as set forth below, motions, applications, and other requests for relief filed in Chapter 7 and 13 cases are "self-scheduled." Any of the available dates and times set forth below may be selected to schedule a hearing without contacting the Court for a hearing date.

Matters Excluded From Self-Scheduling. Hearings on the following matters shall not be self-scheduled. Hearings on these mattes shall only be scheduled by the Court. Hearing dates may be obtained by contacting Diane Corsini, the Courtroom Deputy, at (631) 712-6278.

Evidentiary Hearings (including evidentiary hearings for contested matters in the main bankruptcy case)
Emergency/Expedited Hearings
Motion to dismiss, Motion for summary judgment or Motion for default judgment. The motions shall be filed without a Notice of Hearing. The Court will issue a scheduling order. The Court will determine whether argument will be heard and, if so, will advise the parties.

Procedures Applicable to Chapter 11 Cases

Scheduling of Hearings. All matters, whether in the main case or in any related adversary proceeding, will be scheduled by the Court. Hearing dates may be obtained by contacting Diane Corsini, the Courtroom Deputy, at (631) 712-6278.

First Day Matters in Chapter 11 Cases. Parties wishing to schedule first day hearings in Chapter 11 cases shall contact Diane Corsini, the Courtroom Deputy, at (631) 712-6278, on the date of filing to discuss scheduling of the hearing. In advance of the hearing, counsel for the debtor shall provide Chambers with (i) two copies of the first day motions and any responses or objections thereto, (ii) a proposed agenda for the first day hearing, (iii) an affidavit or declaration of a representative of the debtor in support of the first day motions, (iv) the proposed order scheduling the first day hearing, and (v) any proposed orders relating to the relief requested in the first day motions. It is expected that debtor's counsel will have consulted with the United States Trustee in advance regarding all relief to be requested at the first day hearing.
